These Terms and Conditions (“Terms”) govern your use of this website and any services provided by AMD Accounting & Business Advisory (ABN 32 692 121 878) a trading business of AMD Advisory Group Pty Ltd (ACN 692 121 878) and AMD AA Tax (ABN 93 671 788 355) a trading business of The Accounting Academy Services Pty Limited (ACN 671 788 355) (“we”, “us”, “our”). By accessing or using this website, you agree to comply with these Terms. If you do not agree, do not use this website.

2. Use of Website

  • You may use this website for lawful purposes only.

  • You must not interfere with the operation, security, or functionality of the website.

  • You may not copy, reproduce, distribute, or modify content without our written consent.

3. Professional Advice Disclaimer

  • Information on this website is general in nature and does not constitute accounting, financial, tax, legal, or business advice.

  • Reliance on website content without engaging us through a formal engagement letter is at your own risk.

4. Services and Engagement

  • Accessing this website does not create a client relationship.

  • All of the prices quoted on this website excludes GST, unless otherwise stated.

  • All services are governed by a separate Engagement Letter. The Engagement Letter terms prevail over these website Terms for any services provided.

  • Services may include accounting, tax advisory, business advisory, financial modelling, CFO advisory, Xero support, and company secretarial services.

5. Professional Membership and Liability

  • AMD Advisory Group Pty Ltd and The Accounting Academy Services Pty Limited are members of Chartered Accountants Australia and New Zealand (CA ANZ).

  • Liability for professional services is limited by a scheme approved under Professional Standards Legislation.

  • Our services are provided in accordance with professional and ethical standards applicable to accounting professionals, relevant Australian accounting standards, and industry best practice.

6. Fees and Billing

  • All services are billed in accordance with the Engagement Letter.

  • Monthly plans may be cancelled with 30 days’ written notice prior to the next billing date.

  • Once-off/pay-as-you-go services may be terminated with 7 days’ written notice unless work has commenced, in which case fees for work performed apply.

  • Payment terms, methods, and additional costs are as outlined in the Engagement Letter.

  • Merchant Payment Fees: Where the Client elects to pay invoices via credit card, PayPal, or other electronic payment method, any merchant or processing fees charged by the payment provider may be passed on to the Client and included in the total invoice amount. The Client agrees to pay such fees in addition to the fees for services provided.

7. Intellectual Property

  • All website content, materials, models, templates, and intellectual property belong to AMD Advisory Group Pty Ltd.

  • Users may not reproduce, modify, or distribute content without our written consent.

  • Any IP provided as part of client services is subject to the Engagement Letter, including ownership of new and pre-existing IP.

8. Limitation of Liability

  • We do not accept liability for any losses arising from use of the website or reliance on website information.

  • Liability for services is limited to the terms set out in the Engagement Letter and to the maximum extent permitted by law.

  • We are not liable for indirect, consequential, or economic losses, or for incorrect or incomplete information provided by website users.

9. Privacy and Data Collection

  • Any personal information submitted through contact forms or via email is collected and used in accordance with our Privacy Policy.

10. Termination of Services

  • Engagements with us can be terminated in accordance with the Engagement Letter.

  • Written notice includes email sent to our registered business email address.

11. Governing Law

  • These Terms and any website use are governed by the laws of New South Wales, Australia.
